§ 34-36. Chief deputy

  • (a) The position of chief deputy is hereby created within the sheriff's department.

    (b) The chief deputy shall be hired by the civil service commission, the same as any other deputy sheriff. He shall be appointed by the sheriff in the same manner as deputy sheriffs under this article. The qualifications of the chief deputy shall be determined by the commission.

    (c) He shall hold office in the same manner as any other deputy sheriff.

    (d) The chief deputy shall outrank all other personnel in the sheriff's department except the sheriff. The chief deputy shall perform duties as follows:

    (1) Act for the sheriff in his absence.

    (2) Assign and inspect work of deputy sheriffs and other personnel in the department.

    (3) Advise department personnel of polices and procedures of the department.

    (4) Keep records and make reports as directed by the sheriff.

    (5) Prepare and make recommendations to the sheriff.

    (6) Carry out all delegated duties essential to the efficient administration and operation of the department, as ordered by the sheriff.

    (7) Make complaints to the sheriff concerning discipline of department personnel.

    (e) The tenure of the chief deputy shall be subject to all of the provisions of the civil service agreement.

    (f) The salary of this position shall be set by the county board and may be changed from time to time by an official act of the county board.

    (g) The chief deputy may be dismissed or demoted for all of the causes specified in the civil service agreement and as specified in Wis. Stats. § 59.21(8)(b), and good cause shall also include efficiency in all of his duties. However, good cause shall not include the fact that he has made complaints against other deputies under him in cases where he has good reason to believe that the complaint so made is well founded, even though such complaint is not processed or may later be proven untrue.
