§ 34-33. Application for position of deputy sheriff; qualifications; examination of candidates

  • (a) Every candidate for the position of deputy sheriff shall file a written application with the sheriff's department upon forms provided by the sheriff. Applications shall be designed by the commission.

    (b) No person shall be eligible to apply or to be appointed to the position of deputy sheriff unless the applicant:

    (1) Is a citizen of the United States and a resident of Wisconsin.

    (2) Is a high school graduate.

    (3) Is not less than 21 years of age.

    (4) Has not been convicted at any time or any place of a felony unless the judgment or conviction has been reversed or a complete pardon has been granted.

    (5) Has uncorrected vision of 20-40 which is correctible to 20-20 and possesses good color vision.

    (6) Possesses a valid Wisconsin driver's license.

    (c) The commission shall conduct an examination, oral or written or both, to determine the character, reputation and qualifications of all candidates and shall avail itself of the facility of the sheriff's department in conducting such examination of all candidates. The commission shall refuse to examine a candidate and after examination to certify a candidate as eligible who:

    (1) Is found to lack any of the examination preliminary requirements for the position for which he applies.

    (2) Is physically impaired or so disabled as to be rated unfit for the performance of duties of the position of which he seeks appointment.

    (3) Is addicted to the habitual use of intoxicating beverages or dangerous drugs.

    (4) Has a prior unsatisfactory work record.

    (5) Has used or attempted to use any personal or political influence to further his eligibility or appointment.

    (6) Has intentionally made a false statement in any material fact.

    (7) Has practiced or attempted to practice any discrepancy or fraud in his application or examination.

    (d) The method of grading all applications shall be determined by the commission. Preference shall be given to the veterans of any war of the United States in the manner indicated in Wis. Stats. § 63.05(2). Consideration should be given for previous experience, training, age and written or oral tests. Such examinations shall be conducted by the commission whenever a vacancy occurs in the department or whenever the deputy personnel is increased. The commission should give notice of the time, date and place for the examination for any position within the sheriff's department.

    (e) Any person applying for the position of deputy sheriff may be required by the commission to and shall submit to and pass medical and physical tests to be conducted by such physician as shall be desired by the commission. Such physician shall submit a statement to the commission that the applicant is of sound health and has the physical ability to perform the duties of the position in which he seeks appointment. If a candidate is dissatisfied with the report of the physician's examination, he may be reexamined by another doctor selected by the commission at the candidate's expense.

    (f) The commission shall certify to the sheriff the names of three persons standing highest on its list from which he shall make his selection. If more than one vacancy is to be filled, the commission shall certify to the sheriff one additional person from the list for each additional vacancy. Such list of applications shall be valid for one year.
