§ 22-121. State regulations adopted

  • (a) Wis. Stats. § 252.23 (relating to regulation of tattooists), Wis. Stats. § 252.24 (relating to regulation of body piercing and body-piercing establishments), and Wis. Stats. § 252.25 (relating to violation of laws relating to health) are incorporated by reference. A violation of any of those sections shall be punished as provided in:

    (1) The statutory section violated, except that, for purposes of enforcing a statutory violation as an ordinance violation:

    a. Any statutory reference to a fine shall be deemed a reference to a forfeiture; and

    b. Any statutory reference to imprisonment shall be ignored; or

    (2) Section 17.90(6) of the county land use code; or

    (3) Both subsections (a)(1) and (a)(2) of this section.

    (b) Wis. Admin. Code ch. HFS 173 (relating to tattooing and body piercing) is incorporated by reference. A violation of Wis. Admin. Code ch. HFS 173 shall be punished as provided in:

    (1) The Administrative Code section violated, except that, for purposes of enforcing an Administrative Code violation as an ordinance violation:

    a. Any Administrative Code reference to a fine shall be deemed a reference to a forfeiture;

    b. Any Administrative Code reference to imprisonment shall be ignored; and

    c. Any Administrative Code reference to an appeal requiring the participation of the state department of health and family services shall be ignored; or

    (2) Section 17.90(6) of the county land use code; or

    (3) Both subsections (b)(1) and (b)(2) of this section.
